Pilot Program
Our 14-day pilot program allows businesses to test our Services with no long-term commitment. Pilot terms include:
- Setup and integration with existing systems
- Defined usage allowance based on booking volume
- Performance reporting at pilot conclusion
- Option to continue services based on results
User Obligations
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Comply with all applicable laws and regulations
- Use the Services only for lawful business purposes
- Not attempt to interfere with or disrupt the Services
Payment Terms
Pricing for ongoing services is based on booking volume and features required. Payment terms include:
- Pilot pricing as agreed during onboarding
- Usage-based billing for volume exceeding pilot allowance
- Monthly or annual billing cycles for ongoing services
- Payment due within terms specified in your agreement
Intellectual Property
YamaXAI retains all rights, title, and interest in the Services, including all software, technology, and intellectual property. You are granted a limited, non-exclusive license to use the Services during your subscription period.
Data Usage and Privacy
Your use of our Services is subject to our Privacy Policy. We collect and process data necessary to provide the Services, including booking information, payment data, and customer communications.
Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform scheduled maintenance and are not liable for service interruptions outside our reasonable control.
Limitation of Liability
To the maximum extent permitted by law, YamaXAI shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of revenue, profits, or business opportunities
- Data loss or corruption
- Third-party service failures or integrations
Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
Warranties and Disclaimers
The Services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Services will meet your specific requirements or be error-free.
Termination
Either party may terminate services with written notice as specified in your agreement. Upon termination:
- Access to the Services will be discontinued
- Outstanding payments become immediately due
- You may request export of your data within 30 days
Modifications to Terms
We may modify these Terms from time to time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction or as otherwise specified in your Service Agreement.
For customers in Australia: These Terms are governed by the laws of Australia, and any disputes shall be resolved in the courts of Australia.
For customers in India: These Terms are governed by the laws of India, and any disputes shall be resolved in the courts of India.
For customers in other regions: Governing law and jurisdiction will be specified in your Service Agreement or as otherwise communicated during service onboarding.
Dispute Resolution
For any disputes arising from these Terms, the parties agree to first attempt resolution through good faith negotiation. If unsuccessful, disputes may be resolved through mediation before pursuing legal action.
Entire Agreement
These Terms, together with our Privacy Policy and any specific service agreement, constitute the entire agreement between you and YamaXAI regarding use of the Services.
